Default Intrastate Child Support Enforcement

Anyone have any experience with this? I just spoke with my caseworker in Ohio. They are giving ex until 7/31 to become current or they are going to begin the process of suspending his license and send the case to his homestate, Georgia for enforcement action. She said it could take 3-4 months to register the case there and begin the contempt action.

He's $7,200 in arrears and $2000 behind on medical, and he dropped insurance so he has to do that as well. She said it is not ideal to send it out of state for enforcement but since he lives there they cannot order him back to Ohio to face contempt, it has to be done in Georgia now.

Anyone have any thoughts on this?

Nope, Just Pray. Also later he might be sued civilly by you or your children. I have heard of adult children taking deadbeats to court and winning many years after.

Really??? I didn't know that?!? I THINK IT'S AWESOME. Those kids must be strong to be able to do that.

The only advice I have is... be patient and persistent. When you are dealing with two different states everything takes twice as long to get results. Document every time you talk to your worker and what they tell you. They have to give the other state at least 30 days to receive and respond to any paperwork that is sent to them. And then on top of that the other state has to enter all the information into their system and then take the legal steps to enforce it. Keep on top of it and keep calling your worker to get status updates of what is going on and if they have heard from the other state. I just went through something similiar with my oldest boy's father. He lives in Texas. There was an adjustment to the CS order that was sent to Texas 18 months ago. It was just put into action a week ago. He also is in arrears, over $20,000, and many times I have been told that they were going to start action to suspend his license or even charge him with contempt and it was never done.

I know that anything that I file here in WA for child support, my ex will have to go to court in OR. Some of it will depend on how well the two states communicat with each other.

The Good News is that he's in Georgia...
They are RUTHLESS when it comes to enforcing CS orders from ANY state!

I have heard horror stories on some of the things they do...Whole paychecks gone, Jail Time, you name it they have done it!

My Caseworker gave me the more omnious view of having that third state involved and they won't pursue as diligently as we (which is to say none), etc., so I'm taking your crumb of hope.

Well some states are very ruthless in enforcing, but some of that comes down to you -- you have to know WHERE to find him. A lot of times the interstate child support enforcement fails because the parent does not know where to find the non custodial parent. In this case, you know. And yes, DC is right, some of those southern states will grill the nonpaying father. You also have a right to know who that caseworker is that is assigned to you in Georgia and can talk to them.

I have no info but I just want say that I am now joining the interstate child support party. My ex just moved to georgia. I hope everything works out for you.
